Terms and Conditions

1. Purpose

These terms and conditions govern access to and use of the Patissio platform (hereinafter “the Platform”), available at patissio.com and on its subdomains. They form a contract between MBEN DEV, the publisher of Patissio, and anyone who creates an account on the Platform.

Creating an account constitutes unreserved acceptance of these terms. If you do not accept them, do not use the Platform.

2. Definitions

  • Patissio: the Service published by MBEN DEV, a French limited liability company (SARL) with share capital of €1, registered with the Paris Trade and Companies Register under number 932 130 735, whose registered office is at 60 rue François Ier, 75008 Paris, France.
  • Pastry chef: the professional who takes out a subscription and publishes their showcase website, catalogue and workshops on the Platform.
  • End customer: the person who orders from a Pastry chef, books a workshop or requests a quote via the Platform.
  • Content: any item published by a Pastry chef — text, photographs, prices, product sheets, recipes, allergen information.

3. Patissio’s role

Patissio provides a tool. Patissio is not a party to the contract concluded between a Pastry chef and their End customer: it sells no pastries, organises no workshops and makes nothing.

The sale, preparation, product compliance, deadlines, collection or delivery, after-sales service and compliance with applicable regulations are the sole responsibility of the Pastry chef. Any complaint about an order must be addressed directly to them.

4. Account and access

  • Registration is reserved for professionals. The Pastry chef guarantees the accuracy of the information provided and keeps it up to date.
  • Login credentials are personal and confidential. The Pastry chef is responsible for all activity carried out from their account. Any suspicious use must be reported without delay to contact@patissio.com.
  • The Pastry chef can enable two-factor authentication from their dashboard, and we recommend doing so.

5. Plans and pricing

Three plans are available:

  • Starter — free. A showcase website on an address such as patissio.com/your-name, with in-shop sales (full payment at the catalogue) subject to a commission — see article 7. Custom quotes are reserved for paid plans.
  • Pro — €29 per month. Dedicated subdomain, online orders and quotes.
  • Premium — €49 per month. Custom domain name, workshops and courses, access to the connector for AI assistants, in addition to the features of the Pro plan.

Prices are shown excluding tax, in euros. They may change; any change is notified at least thirty days in advance and applies only from the next billing date. The Pastry chef may then cancel free of charge.

6. Subscription, billing, cancellation

  • The subscription is monthly, with no minimum term, tacitly renewed at each billing date. Payment is collected by Stripe at the start of each period.
  • Cancellation is carried out from the dashboard. It takes effect at the end of the current period: amounts already paid for the ongoing period are not refunded, and access remains open until the end of the term.
  • In the event of a failed payment, access to paid features may be suspended after an unsuccessful reminder. The account then reverts to the free plan.
  • As this is a contract concluded between professionals for the purposes of their business, the right of withdrawal under consumer law does not apply.

7. End-customer payments and commission

Deposits and payments made by End customers pass through Stripe, via a Stripe Connect account opened in the Pastry chef’s name. Patissio never holds End customers’ funds and carries out no payment-services activity.

On each payment collected, Patissio retains a commission, to which are added the processing fees charged by Stripe for that transaction. The commission rate depends on the plan subscribed to and the nature of the sale:

  • In-shop sales (full payment at the catalogue) on the free plan: a commission of 7% of the amount paid by the End customer. It is this commission that remunerates the Platform for Pastry chefs who do not take out a subscription.
  • All sales on the paid plans (Pro, Premium), as well as custom-quote deposits and workshop deposits: a commission of 0.43% of the amount paid. The subscription then replaces the in-shop commission.

The balance is paid out to the Pastry chef on their Stripe Connect account. Examples for a payment of €100: on an in-shop sale under the free plan, roughly €1.92 in Stripe fees and €7 in Patissio commission are retained, and €91.08 goes to the Pastry chef; on a paid plan, roughly €1.92 in Stripe fees and €0.43 in commission are retained, and €97.65 goes to the Pastry chef. Stripe fees depend on the payment method used by the End customer — a card issued outside the European Union costs more — and follow Stripe’s pricing, which Patissio does not set.

The details of each payment collected, commission included, can be viewed by the Pastry chef from their Stripe dashboard. Any change to the commission rate is notified at least thirty days in advance; the Pastry chef may then cancel free of charge.

8. Pastry chef’s obligations

The Pastry chef undertakes to:

  • publish accurate Content — in particular prices, composition, allergens and storage conditions — and comply with the food-safety regulations and consumer-information rules applicable to their business;
  • publish only Content to which they hold the rights, and use no photograph or trademark belonging to a third party without authorisation;
  • honour accepted orders, and handle their End customers’ requests within a reasonable time;
  • comply with their own personal-data obligations towards their End customers, for whom they are the data controller;
  • not divert the Platform from its purpose, not attempt to access another Pastry chef’s data, and not disrupt its operation.

9. Prohibited content

In particular, content that is unlawful, misleading, infringing, or that harms privacy or dignity is prohibited, as is any offer unrelated to a pastry business. Patissio may remove manifestly unlawful Content and, where appropriate, suspend the account concerned.

10. Connector for AI assistants

From the Pro plan onwards, the Pastry chef can connect a conversational assistant to their account. This connection is optional and revocable at any time from Settings › Agent access.

The Pastry chef chooses the permissions granted and remains responsible for how they use it, including messages sent to their End customers by this means. The data transmitted to the assistant’s publisher is described in section 7 of the privacy policy. Patissio guarantees neither the accuracy nor the relevance of the responses produced by a third-party assistant: business decisions remain those of the Pastry chef.

11. Intellectual property

The Platform, its brand, its code and its graphic elements remain the property of Patissio. The subscription grants a personal, non-exclusive and non-transferable right of use for the duration of the subscription.

The Pastry chef retains full ownership of their Content. They grant Patissio, for the sole duration of the subscription, the right to host, reproduce and display it for the purposes of operating the Platform, as well as to reference it on search engines.

12. Availability and maintenance

Patissio uses reasonable means to ensure the availability of the service, without guaranteeing uninterrupted access. Maintenance operations may temporarily suspend access; those that are scheduled and likely to disrupt activity are announced in advance where possible.

13. Liability

Patissio is liable for direct damage resulting from a breach attributable to it. Indirect damage is excluded, in particular the loss of revenue, customers or data attributable to the Pastry chef. In any event, Patissio’s liability is limited to the amounts actually paid by the Pastry chef over the twelve months preceding the triggering event.

These limitations apply neither in the event of gross negligence or wilful misconduct, nor in cases where the law sets them aside.

14. Personal data

The processing of personal data is described in the privacy policy, which forms an integral part of these terms. The Pastry chef is the data controller for their End customers’ data; Patissio acts in this respect as a processor, within the limits specified therein.

15. Suspension and termination by Patissio

In the event of a serious breach of these terms — unlawful content, a threat to the security of the Platform, persistent non-payment — Patissio may suspend access after a formal notice that has remained without effect for fifteen days, save in an emergency justifying immediate suspension. The Pastry chef may then retrieve their data in accordance with the terms of the privacy policy.

16. Amendment of the terms

Patissio may amend these terms. Any substantial amendment is notified at least thirty days before it takes effect. Failing cancellation before that date, the new terms are deemed accepted.

17. Governing law and disputes

These terms are governed by French law. In the event of a dispute, the parties shall endeavour to reach an amicable solution before any legal action. Failing agreement, exclusive jurisdiction is granted to the courts having jurisdiction over the registered office in Paris, including in summary proceedings and notwithstanding multiple defendants or third-party proceedings.
